My indiana hoa association for my condo that has failed to keep up repair on the roof common elements and now i have damage inside my condo on the ceiling.
The hoa replaced the roof and damaged my ceiling.
The hoa collects dues from each unit owner to pay for maintenance and repairs defined in the by laws.
Hoa or condo association duty.
The board states that the interior is my responsibility.
However the roof repairs have been neglected for years because they did.
They covered the costs of cleaning up and repairing the ceiling.
They say they don t have responsibility for anything inside the walls of my condo.
Therefore if the unit s walls or ceiling are water or mold damaged it is the condominium s duty and obligation to replace the drywall.
If the damage occurred due to problems with the roof you can hold the hoa responsible for paying to repair any damage caused by the roof leak as well as compensating you for any expenses you have incurred due to the damage.
L a i am sorry that you have had damage from a roof leak to your condo.
The hoa has a duty to maintain the roof so that no water infiltration occurs.
As annoying as the original leak is it is often the clean up and repair that create the lingering problem.
Everyone was fine but there was a good 4 hole in the ceiling plaster.
09 16 2011 1 15 pm i recently asked my hoa if they would pay for an inspection of my townhouse roof after a heavy hail storm as the covenant states they are responsible for the maintenance repair and replaced of roofs as a common area.
Damages during the roof replacement are definitely on the roofing contractor.
In june we had heavy rain.
Ultimately though there is going to be a negotiation between insurance companies.
Now i have a hole in my ceiling and large stains.
Water came in to my condo and has damaged my windows cabinets flooring and back splash in my kitchen.
We just had the roof done on our sfh and during the tear off one of the workers fell through the roof into the upstairs bedroom.
I was told that the hoa will replace the drywall on the ceiling and walls but not the paint and not the wood blinds that were ruined due to the leak.
If the leak and subsequent damage are both in a common area then the association is responsible for the cost of remediation.
The association of my condo has failed to fix the roof properly over the years and has done patch work to fix spots here and there.
Typically the condo unit owner is responsible for the finished interior surface or the covering of the drywall however the condominium is responsible for the drywall itself.
Condo or homeowner duty.
